Terms of Service

These Terms govern your use of Tapeo. By creating an account or otherwise using the Service, you agree to them.
01Identity of the service provider
Tapeo is operated by ATOMIRA TECHNOLOGIES, S.L. (the “Company”, “we”, “us”), a Spanish sociedad limitada with:

02What Tapeo is
Tapeo is a software service (SaaS) that lets bars and restaurants publish a digital menu accessible by QR code, scan a chalkboard or printed menu and have it digitized in seconds, translate menus into seven languages, auto-detect EU-1169 allergens from dish names, accept table-side orders from diners, and operate a kitchen display and staff surface. The customer-facing menu is free of ads and watermarks.
03Eligibility and your account
To open a venue operator account on Tapeo you must be at least 18 years old or, if you act on behalf of a venue, you must have authority to bind that venue (its operator, manager, or owner). The Service is currently invite-only — see § 5.
Creating an account requires a valid email address. You may sign in with Google OAuth or a magic-link email. You are responsible for the security of the email inbox associated with your account — whoever can receive magic-link emails can sign in. You agree to provide accurate information at registration, keep it up to date, and not impersonate any other person or entity.
You may close your account at any time by writing to hola@tapeo.menu. Closure triggers data deletion as described in our Privacy Policy.
04Acceptable use
You agree not to:
- Upload menu content that is illegal, fraudulent, infringes third-party rights, or misrepresents allergens contrary to EU Regulation 1169/2011.
- Attempt to reverse-engineer the Service, bypass rate limits, or probe it for vulnerabilities outside a published responsible-disclosure programme.
- Use the Service to send spam, phishing, or unsolicited commercial communications to diners.
- Resell, relabel, or re-publish the Service as your own without a written partner agreement.
- Use Tapeo to train a competing menu-OCR / menu-translation / allergen-detection model from your venue’s Tapeo-generated content. (This restriction applies to AI training only; you remain free to use the Service’s outputs in your venue.)
Violation may result in suspension or termination of your account without refund of any pre-paid amount.
05Alpha period
Tapeo is in invite-only closed alpha. During the alpha period you may use the Service only if your email is on the active invite list. The Service is provided as-is for evaluation purposes; behavior, prices, and features may change before General Availability. We will give reasonable notice before any material reduction of features available during the alpha.
When you accept your alpha invite, you also accept the Alpha Tester Agreement at /legal/acuerdo-alfa, which sets out alpha-specific terms (no SLA, feedback licence, confidentiality of unreleased features, operational-log practices) that supplement these Terms during the alpha period.
06Your content
You retain all rights to the menu content you upload (dish names, descriptions, prices, photographs, translations). You grant Tapeo a limited, non-exclusive, worldwide, royalty-free licence to store, transmit, transform, translate, OCR-digitize, and display the content for the sole purpose of operating the Service. Storage is on Hetzner Online GmbH infrastructure in the EU.
The licence terminates when you delete your content or close your account, except where we are legally required to retain certain records (e.g. tax invoices once Pro billing ships).
You are responsible for the accuracy of prices, ingredients, and allergens published through the Service. Automatic translations and AI-assisted scanning are best-effort suggestions — see § 7. You review them before they reach a diner.
07AI features and disclaimers
Tapeo uses Google Gemini for chalkboard / printed-menu OCR, translation into up to seven languages, EU-1169 allergen detection from dish names, and the weekly insights summary. AI suggestions appear in the editor for you to review before publication.
The AI generates suggestions only. We do not guarantee the accuracy, completeness, or appropriateness of any AI output. You remain responsible for the final published menu, including the allergen disclosure required by EU Regulation 1169/2011 and any local food-safety regulation.
No AI feature in Tapeo makes a decision about you with legal or similarly significant effect (Article 22 GDPR is not triggered). We comply with applicable obligations of Regulation (EU) 2024/1689 (AI Act) for our use of a general-purpose AI model and disclose the model provider (Google) here and in the Privacy Policy. You may disable optional AI features in your account settings.
08Plans and billing
- Free plan — €0 / month. QR menu, chalkboard OCR, automatic translations, menú del día, three price zones (barra / mesa / terraza). No credit card required.
- Pro plan (when it lights up) — €19 / month. Staff tablet (PIN-gated POS), table-side ordering, kitchen display, call-waiter / call-bill / call-water buttons, push notifications, weekly Gemini-powered insights email. Card and Bizum payments follow when Stripe Connect ships.
- No commission on orders placed through the Service — ever, on any plan.
When Pro billing ships, billing is monthly and renews automatically. You will be able to cancel at any time from your dashboard or by email; cancellation will take effect at the end of the then-current billing period. Spanish VAT (IVA) is added where applicable. EU-consumer withdrawal rights under the LGDCU will apply where relevant; the full mechanics will be described in the Refund Policy published at the same time as Pro launches.
09Service availability
We make commercially reasonable efforts to keep the Service available, but do not guarantee uninterrupted access. Planned maintenance is performed outside Spanish bar peak hours (13:00–16:00 and 20:00–23:00 CET) whenever possible. Unless we have separately agreed an SLA with you in writing, the Service is provided on a best-effort basis with no uptime guarantee.
10Suspension and termination
You may terminate your account at any time from account settings or by writing to hola@tapeo.menu. We may suspend or terminate your account if you breach these Terms (including § 4 Acceptable use), if we are required to do so by law, if you fail to pay applicable fees, or if we discontinue the Service or a feature with reasonable notice. On termination, your right to access the Service ends and your data is treated as described in our Privacy Policy.
11Disclaimer and limitation of liability
To the maximum extent permitted by Spanish law, the Service is provided as is and as available without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defect will be corrected, and we do not warrant that AI features will produce accurate, complete, or non-infringing outputs.
To the maximum extent permitted by applicable law, the Company is not liable for indirect or consequential damages (lost profits, lost data unrelated to our processing, reputational harm). Our aggregate liability arising out of or relating to these Terms or the Service shall not exceed the fees actually paid by you to the Company in the twelve months preceding the event giving rise to the liability. Where the Service is provided at no cost, this amount is €0.
Nothing in this section limits or excludes liability that cannot be limited or excluded under applicable law, including liability for fraud or gross negligence, the right of compensation under Article 82 GDPR, and the mandatory consumer rights of EU residents under EU and Spanish consumer law.
12Privacy and data protection
Personal data is processed as described in our Privacy Policy at /legal/privacidad, which forms part of these Terms. Cookies and similar technologies are described in the Cookie Policy at /legal/cookies.
13Governing law and jurisdiction
These Terms are governed by the laws of Spain. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Barcelona, Spain, except where mandatory consumer-protection law grants a consumer the right to bring proceedings in the courts of their habitual residence (in which case those courts also have jurisdiction).

14Changes to these Terms
If we update these Terms materially, we will email account owners at least 30 days before the change takes effect and post the updated text at /legal/terminos. Continued use of the Service after the effective date counts as acceptance. If you do not agree, you may close your account before the effective date.
